Pissed at indymac bank

i applied for modification in 2008 got approved did 3 months trail then got dinied applied for second mod. got approved again dit that for 5 mon. got dinied again ive tried to work with these pepole for over 2 years and cant understand why they dont want to help. if we they told me ive shouldnt have bought the house if i couldnt afford it. they gave me the run arounds for over 2 years now and my house is up on shiriffs sale on nov. 30 can anybody help me? call me please y really dont want t lose my home thanks armando 262 898**** or 262 988 ****

STOP THIS RAPE --THIS REDISTRIBUTION OF WEALTH

Three months ago I filed an app for a home loan modification under the Obama's Hamp Program. I have received two letters stating the documents that are still needed. Indy Mac has continually denied receiving documents or missing pages of documents time after time after I have faxed them. After placing follow up calls, one after the other and often daily, I'm no further along than the day I first submitted my application. Throughout the process, those in the loss mitigation continually move the goal posts as I attempt to jump through hoop after hoop. Living in California, I have filed a complaint with Rep. Dan Lungren, Senators Boxer and Feinstein. Oct. 29, 2010 is the posted date of the foreclosure sale of my home. I am in and ready for a Class Action against Indy Mac Bank/One West Bank.

Loan Modification Nightmare, any advice is welcomed

I received an Indy-mac loan modification 6 wks after applying for it. It was sent to me certified mail, with the amount and the conditions. One week before the 3 month trial was up, they denied it, saying I didn't live in the house. I do live here so after completing several things to prove this, they said they'd continue with the modification. This time the amount was about $200 dollars more per month then the first , but still better then the original loan, so for 8 months Ive paid it. Last week I received notice that Ive been denied, and I'm to repay back all the money they lost during the modification, $14,000. If I don't they will foreclose. I'm confused this seems almost illegal. I don't know who to call or even what to pay. Anyone with advise would be welcomed. I'm wondering if they did this all along, knowing they'd foreclose. This can't be a legal practice. I hired a loan mod. company originally, but after this I don't know who to trust. They say now to get a Lawyer. I owe 485,000, and the house is worth about280,000. I could stay here for about a year without paying. So for them to want to foreclose only means there's something funny going on.

Don't believe anything Indymac tells you. They sent us 3 loan modification apps and they denied ALL 3 !!!!

We short saled the house many months ago and ended up having a FORCLOSURE on our records. If I knew that, I would forclose on the property. And chances are that the foreclosure will stick !!!

Our credit is ruined. We recently went to buy a car and they said there is NO WAY they will give us a loan. They wouldn't even sell us a car with a co signer.

I HAVE NEVER EVER DEALT WITH A BANK LIKE INDYMAC. I will regret the day I signed to re-finance my mortgage with Indymac for the rest of my life.

Indi Mac Mortgage is ruthless they rather have you loose your house than modify your loan

Indy Mac is rutheless and shameless they rather have you loose your property and put you on the street then modify your loan...even though you are able to make the payments that they require on the trial period then after eight months of being on trial and making you waste precious time they denied the application they have a high rate of the defrauding their customers and putting them out on the streets without any regards for how long the owners have been paying their mortgage for the past twenty two years without regards for their present situation. thank you

I am very upset with Indy Mac Bank

I am very upset with Indy Mac Bank. At first they told me to fill out remodification papers, after I filled out the papers they told me that they did not remodify mobile homes. Then I hired a lawyer to help save my home, they told him the same thing and they kept my money. Then they told me to send in more remodification papers they would try to help me save my home. It went up for sheriff's sale, but the week of the sale they were telling me to keep sending in papers. It did no good they still sold the house and I am having to move. We the people gave these banks all this money to help people to save their homes and they are not helping anybody because the government already paid them so if they sell the house that is pure profit for them. Then they will come back on the customer and that is more money in their pockets.

Indymac loan modification

I was paying my mortgage faithfully to Indymac for the period as long as I had them. Now that times are hard and I need a loan modification, They are giving me the run around. I submitted updates of the same infor requested 3 times and now they are asking me for the 4th time. They never call me. It only when I call them for status on my modification that they would tell me I need another update. I am tired and just need to get advice on what I should do next. There is no help from them.

I tried to find help on all these blogs and web sites, there is not ONE SINGLE comment about a company, attorney, individual, organization that get good results with Indymac. I read about class action sue and NO ACTION...

Can we get together and protest to the TV stations, someone may be willing to bring out complaints to the public.

I was standing in line for the NACA event in LA to help a friend,( that is going thru some very hard times ) by the way my house does not qualify since mine is a jumbo loan. She had a real hardship, her son was killed in April, she had three months of very little income because he shared the house with her and helped her with half of the mortgage and now she needs to work 16 hours per day to be able to make the payment and INDYMAC... declined to help her.

She didn't qualify because she didn't have enough money the last three months. She showed them his dead certificate, funeral expenses, proof of now beeing able to work after her son'd death...

they DON'T CARE...She has 4 small grandchildren living wiht her and facing foreclosure. This is INSANE.

PLEASE everyone who has problems with indy mac over modification record conversations YOU MUST TELL THEM YOU ARE RECORDING THE CONVERSATION. ALSO GET ALL INFORMATION AS TO WHO YOU ARE TALKING TO NAME AND BADGE # ETC It is best to do everything by mail with a post office receipt of mailing or certified mail etc proof of mailing is very cheap about 1.50 it just proves you went into post office and mailed a letter just put indy macs name and address and you return address on form at post office call them to see if them received you last mailing and call often. document everything in case you have to go to court PLEASE THERE WILL BE CLASS ACTION LAW SUIT AGAINST THEM.

IndyMac

IndyMac is the most unethical company that I've ever had the misfortune of dealing with. They don't answer or return calls and will scam you. I'm glad to see there is a class action law suit. If anyone has info. on how to get in on it, please let me know. If I'd had the money, I would have gotten an attorney to fight them on my own. My son got behind on his loan and they had him redo the terms. After receiving his money, they tried to claim they never rec'd the forms back. After numerous unanswered phone calls, we finally reached someone and refaxed, including the first confirmation. Meanwhile they changed the dates and added unreasonable fees. He got that straightened out and made payments, however, several months later IndyMac claimed they never rec'd payments,foreclosed on the home with a week notice, his renters were evicted and he had to pay them for breaking the lease. He was later told that the payments had not been posted to his mortgage account because they didn't know how to apply them and had them set up in another account but it was too late unless he wanted to pay another $5000 up front in attorney fees and redo the loan again.

I am having the same issue with IndyMac. I rec'd a voucher from Metro Action to be applied to my July 2010 payment.

Someone let the voucher sit on their desk so that It was able to expire. After numerious calls from me it was finnaly located & the customer svc rep promised to get it paid. When I rec'd a letter about foreclosure I call back & there werent any notes about my voucher.

Again the rep said that they would handle this right away. This has been going on since July 2010.

check it out indy mac/one west bank are one in the same. they make money if your property value goes down and they forclose. there loss is protected with liability agreement with our gov.Very few hard working americans get a modification with them. check it out yourselves, and call your Representatives and above all hire a lawyer. I am still fighting my battle. they keep stalling,and we fillout form after form, usually same ones. check out aerical entitles indy mac/one west bank sweet heart deal.Goggle it!!!!we been tring since 2009 and have gotten foreclosure notice

I have contacted Indymac several times regarding loan modification. Each time I have spoken to someone new (new to me)...Each time I have become informed that my paperwork application was not in order or something was missing (despite my saying I have faxed through 3 times - and confirmed receipt)...People seem to be reading a script....I told one that all I could afford to pay was $2200 per month....and was told to make sure I made provision for paying the new rate.

Some have said that there is nothing to be done.

Ive been trying to negotiate for my aunt in reference to her mortgage with indy bank. You can never speak to anyone they only have people answering the phone and it sounds like that they are reading a script.

Good attorneys don't usually charge anything for good class action law suits They make out like a fat rat and are usually the only real winners. Often, they will solicit others and ask them to join at no charge.

Indymac/One West Bank Nightmare

I am a homeowner in New Jersey, and I have been struggling with my loan modification since 2007-****. I have yet to hear of a final decision from Indymac/One West Bank, the servicer of my loan. My struggles began when I seperated from my fiance. We had finances together, but when we seperated, he liquidated everything. I was left with very little, so I contacted Indymac/One West Bank to explain my situation. I felt that I would be responsible if I called in the problem before it evolves into something bigger. Little did I know, Indymac/OneWest Bank created a monster for me. From my phone call, I was put on a forbearance program, which I was told was the first step to a modification. They failed to take out my payments on time, even after the direct withdraw, and my account slowly became delinquent. With little cooperation from the customer service reps, I knew that I was in a tough battle. In 2008, the battle became worse with HAMP. At this time, I met my now husband, and we were expecting. Due to complications in my pregnancy, I was put on bedrest for quite some time. I called Indymac/OneWest Bank again, and the customer service rep told me that my newborn was going to go home to a foreclosed house. He ridiculed me and badgered me until I was sick again, and the doctors and nurses ordered him off the line. After complying with the HAMP trial period, I was bewildered to find out that I was denied for the permanent modification. I applied three times thereafter, only to be denied again and again. I kept all of my records, and wrote twenty different letters to twenty different government officials to complain. Congressman Steve Rothman responded to my concerns, and he provided me information about St. John's Mortgage Recovery Services. This organization is a non-profit group that professionaly educates homeowners, like myself, on why the banks do not want to modify. Then, they conduct forensic audits and advocate for the homeowner based on current procedures and policies built into the bank's system that are ultimately created to protect the homeowner. Although, I am still in the process of fighting, I feel confident that I was recommended to St. John's. I would like to help anyone who is also struggling. I can understand how troubling this entire situation can be, but we are not alone. It took me a long, long time to realize that this is a pandemic, and without the proper resources, we may not win. One West Bank/IndyMac blasts 87yo Woman

This letter is from an 87-year-old woman who owns a Horse ranch in North San Diego County, California. We re-train abused and abandoned horses to be used in therapeutic riding programs for special needs children. One West Bank/Indy Mac took over when First Federal Bank failed and was unable to accept/apply payment for a couple months. I was told that I would receive information when the conversion was done on how/where to make my mortgage payment. I DID NOT. Constant agony and calling One West Bank finally paid off only to find that my mortgage was now considered behind, and that the payment had increased out of reach along with astronomical penalties. To date, I have sent 29 faxes to correct my contact information on record with One West. No luck. It is still wrong. It was suggested by One West Bank that I apply for a mortgage modification. I have sent 32 faxes of a mortgage modification packet, still not received by One West. Was told twice that my ranch is in foreclosure complete with sale dates by One West Customer Service, Brandy. Not true. Was told by Customer Service Representative Michelle that One West does NOT have to issue any notification regarding foreclosure proceedings in California because they are in Austin, TX. NOT TRUE. Have been disconnected 57 times since last November. Have had three B.P.O.s climb over my front gate and take pictures of my horses/trucks and horse trailers to "catalog all assets on the ranch for the sale, including my horses". Not legal. Customer Service Representative Frank explained that One West Bank needs to verify the property is occupied and being maintained. None of the 18 faxes to date of utility bills in my name with address, have prompted any record of occupancy according to the bank. My Son and I have driven a total of 1,126 miles trying to hand deliver the above mentioned documentation to branch locations given to me by Customer Service Reps at One West Bank. None of the information is correct. The last branch location I drove to, was a loan origination dept. in Irvine, CA, with a different name. Once I was foolish enough to ask for a supervisor while on the phone with Customer Service, Kevin. I got lectured that One West Supervisors are busy with important matters and do not waste time with customers who don't pay their bills. It was even explained to me by One West Bank Customer Service that my ranch is worth more to the bank as a foreclosure. I quote, "Mrs. Cowell, the bank has what is called mortgage insurance which pays in full if we can get to property to go to foreclosure. We can then turn around a sell your ranch to make even more money for the bank and we get to go after you for the whole loan amount. We have no interest in working with you to help you stay on the ranch. Welcome to the business world, Mrs. Cowell." "There is a reason we play the recorded debt collection disclaimers, Mrs. Cowell. You are better off moving off the ranch and saving us the trouble, Mrs. Cowell". While I am a woman in my late 80s, I am still not willing to give up on my family, my horses, and the children/families who depend on our ranch. We have the documented income to keep the ranch. As I am old and still believe in honesty, I have been up front with our existing clients regarding the current state of our ranch. All of our existing clients are still here. We have more clients with horses waiting to move onto our ranch for medical/rehabilitative care. Despite the economic doom and gloom, we still have the revenue backing the ranch and our home. Does One West Bank have any staff other than script reading, ill-informed Customer Service Representatives that we can provide the proper documentation to thus solving the perilous fate of our ranch?

I have OneWest/Indymac as the servicer of my home loan. I live in Texas.

They will not speak on modification and recently told me I needed to talk with my investor. I had to write a letter to get the name of my investor which was Wells Fargo. Called Wells Fargo and they didn't even know who I was.

I was not in their system. What's really going on.

I also am having bizzare, nightmare experiences with IndyMac/ One West/ Deutsch Bank. I have a loan with Indy Mac that originated in 2004.

My home was sold to me by Remax and they failed to disclose that the home had huge grading violations, red tags and unstable slopes. I have had to spend thousands of dollars with repairs because of the instablity and in lawyers fees to try to litigate a resolution with Remax.. i missed some payments with Indy Mac because of all this and was immediatly placed into foreclosure status. They told me a sale date was pending so I hired a law firm to help.

They then placed me onto a " trail payment plan". The payments were about $400 less than the actual payment. They said they would work with me diligently to get a modification to the loan,. The loan is a negative amatorization loan and has been determined to be illegal .

I was willing to work with them to get into a legal loan so as to avoid further court costs to myself. I made the new trial payments on time for 9 months. My lawyer and I were both told over and over that everything was status quo and the modification would soon be completed. , Then suddenly Nov !st they refused my trial payment saying they were denying the modifaction.

. i was told my home was set for sale Nov 10th ( Tracy -customer service) .After a zillion frantic calls I was given the name of the Bank's attorney's and was told by them that they had not yet set the foreclosure sale date as they were waiting for the paperwork to come back.. My attorney called to see if we could resubmit the modification papers. He was told we could not because the Bank was not doing any modifucations at all.

All my paperwork is correct and accurate .I have had my application reviewed by an alternate source to see if I do gualily by the hamp guidelines. Apparently i do. I called and called and was finally told I could resubmit for an alternative , in house modification since Indymac/ One West doesn't do any hamp loans. I was told by customer service personnel however that it would be ultimately useless foe me to bother resubmitting as they weren't going to approve any modifications anyways.

,. Well guess who told me that . KEVIN.. I'm with you Mrs Cowell..

he is rude, condescending , arrogant and could give a flaming whatever about whomever.. I notified the Banks Lawyers again and explained that the property was unsaleable due to the inresolved grading violations and red tags and unstable dangerous slopes, I sent then the filed "complaint and demand" to prove this. They told me the bank could sell the home anyways,. i guess to some unsuspecting buyer.

I have received the reinstatement costs from One West and the $30,281.00 that I paid in trial payments is not being included as a credit towards my arrears, I have emphatically brought this to their attention and have demanded to be told where that money has gone to. So far they have not done anything about the missing money other than to state they have ordered a review. After reading Mrs. Cowell;s complaint I don't expect any honesty or integrety or truth at all from this Bank.

They have placed themselves above the law ..the internet is riddled with complaints about their actions. Other Banks are being investigated and whacked for their corruption.. why is this bank going unchecked.. ARE THEY ACTUALLY EXEMPT FROM THE LAW FOR SOME REASON?

It looks like anyone that wants a fair shake from this bank will have no choice but to take it to the courts. But I don't think we should do class action. I think we should all go to court with them, one by one. If they want all the houses..

( didn"t they outgrow monopoly like the rest of us) then let's make them fight us for our houses instead of us trying to defend our rights against them , 80% of their loans have preditory lending violations, Their foreclosure tactics and processing are corrupt and probably quite illegl.

To begin, I must state that I am so sorry that Indymac/OneWest Bank is giving you such a difficult time. Their actions are unprofessional, discourteous and dishonest.

I, too, have been having difficulties with Indymac/OneWest Bank, as they are the servicer to my loan. I own a two-family home in New Jersey. My battles with them began in 2008, and I am still fighting for my home. Indymac Bank now holding my check!

I contacted Indymac at the end of January asking for help with my loan. I had not gone into default, but I knew it was going to happen. I was 7 months pregnant and had been demoted due to my pregnancy. With my demotion came a big cut in income. I asked for options. I was told that they would not help me unless I was at least one month behind. The girl I spoke with told me to not make the next payment. This would qualify me for a loan modification. I did this. I then began receiving letters saying that I was in default and would go to foreclosure if it was not cured. I applied for a loan modification in February. In March, I received a letter asking for updated pay stubs. I faxed them in. That was the last I heard regarding a loan modification. In June, I was $1500 behind. I sent a check for $1000. The next statement said I owed $1900!! They took my payment, then added on multiple fees that doubled what I should have owed. In August, I sent my payment in for one month's payment. I realized last night that they never deposited my check. I read someone else's post on here that this was done to them right before they foreclosed. Has this happened to anyone else? Is there anything that can be done about this?
